SRINAGAR: Facing a legal challenge to the appointment of Commissioner, Srinagar Municipal Corporation over compulsory criteria of minimum years in service, the Jammu and Kashmir Government has expunged the statutory requirement of 15 years of service for an officer to be posted as the administrative head of SMC and Jammu Municipal Corporation.
According to the order, the government shall post a suitable officer as commissioner of the civic bodies irrespective of his/ her years of service
The order has been issued by invoking a provision in the Municipal Corporation Act, which empowers the government to issue executive orders to remove difficulties in the implementation of the law.
Its worth to mentioned here that the J&K High Court has served an ultimatum to the J&K government for filling response over the posting of Commissioner SMC, Amir Athar Khan despite not fulfilling mandatory criteria of 15 years in service.
