    HC issues notice to Vice Chancellor JU over appointment of Graduate as Director IT

    JAMMU: The High Court of Jammu and Kashmir has issued notice to Jammu University,VC -Prof Manoj Dhar and other respondents pertaining to the elevation of Engineer Anik Gupta as Director Center for IT Enabled Services and Management.

    The notice has been issued on a petition filled by Prof. Vibhakar Mansotra through his counsel Advocate Sumit Nayar challenging the order dated 23.10.2020 issued by the registrar university of Jammu for appointment of Er. Anik Gupta has as Director Center for IT enabled services and management in Jammu University.

    In the petition, the  plaintiff submits that Anik Gupta has even not eligible for the post of Director Center IT and does not posses even a Masters degree and became successful by manipulating and getting the scale of professor without facing any screening or evaluation as per the rules of varsity and UGC.

    The counsel of the petitioner apprised the court that there is a very well defined promotional scheme under Career Advancement Scheme (CAS) for the teachers and officers of the University.

    As per this scheme a teacher must have a Master’s and Ph.D degree along with other performance parameters to become eligible for promotion to Reader and Professor. After meeting eligibility conditions, the candidate has to go through various stages of Screening Evaluation and Interview for getting promotion to the post/scale of Reader and Professor.

    Similarly the officers are promoted up to the scale of Reader after going through the various stages of promotion as lay down in the scheme. However, for promotion to the scale of Professor, such officers have to compete in open cadre and may not get promoted to this scale even in the entire service.  In the petition, it’s also stated that there are number of teachers who even after having Master’s and Ph.D qualifications do not get promoted to the Rank of Professor in their entire service career because they either fail to meet certain parameters as defined in the CAS or are not found suitable by the screening/evaluation/interview committees.

    Howver, in an order of its own kind, the university authority have elevated Anik Gupta to the Scale of a Professor and rank of Scientist-G with out meeting any stage of the promotion process and thus need to quashed.
