JAMMU: On the direction of the Court, the Pacca Danga Police has registered a case against Harish Vardhan s/o Krishan Lal and his wife namely Anchal Mengi R/o H.No 11 opposite Balika Niketan Karan Nagar presently putting up at C/o D.R.Mengi H.No 20-A Karan Nagar, Jammu.
The direction for registration of case was passed on the complaint of Waheed Khan wherein who was cheated by the accused couple to the tune of Rs 11 lakhs through fraudulent sale of land deed.
Upon the circumstential evidences placed on records, the court order the PS Pacca Danga for registration of case. The Pacca Danga Police has registered the case against the couple for committing fraud with the complainant u/s 420, 34 of IPC vide FIR No 0013 dated 28/01/2021.
The complainant before the court submitted that the accused couple has offered to sell the sale of four plots tmeasuring 10 marlas each at village Ban Tehsil Nagrota claiming as owner of the plots.
The deal was struck for 27 lakhs for all the four plots and after showing the documents of land, the complainant paid Rs 11 lacs as advanced to the accused couple out of which 6 lacs in cash on 29/11/2019 and a cheque of Rs 5 lacs beating No 006862 dated 26/11/2019 on agreement to sell dated 11/12/2019 which was executed between the applicant and the accused No 1 namely Harish Vardhan with a condition if the later fail to exceute the sale deed in favour of the applicant, he will pay double the amount of the advance.
However, in a pre planned criminal conspiracy with an intention to cheat the complainant, the accused Harish Vardhan when repeatedly asked to prepared extracts of four plots he has offered to sell on the name of Shoba Pathania, the accused shows revenue extracts of only plot 2 plots instead of four and that too which was not actually owned by him. At the time of offer and agreement, the accused accepted the advance amount by claiming owner of four plots.
On realising that he has been cheated by the couple, the complaint approached the Pacca Danga Police station with all the evidences for registration of case against the accuseds. But, the concerned police officer refuses to lodge FIR owing to the influence of the accused who is a known for committing frauds on land deeds in Panjgaran area also.
Finally with the intervention of Court, the PS Pacca Danga has registered the case and started investigation against the accused couple.
