    Hate speech : SC dismisses petition for prosecution against CM Yogi

    NEW DELHI: In an apparent relief to Yogi Adityanath, the three judge bench of Supreme Court headed by Chief Justice, N.V.Ramana has dismissed a plea challenging denial of sanction to prosecute Uttar Pradesh Chief Minister in an alleged case of hate speech in 2007.

    The bench comprising Chief Justice of India, NV Ramana, Justice Hima Kohli and Justice CT Ravikumar pronounced the judgment.

    Reading the operative part of judgement, Justice CT Ravikumar said“In the above circumstances, we do not think it is necessary to go into the legal questions relating to grant of sanction. Consequently, the appeal is dismissed. The question of law is left open”, Justice Ravikumar read out the operative part of the judgment. 

    The petitioner had alleged that Yogi Adityanath had made anti-Muslim hate remarks while addressing “Hindu Yuva Vahini” activists in a meeting held in Gorakhpur on January 27, 2007. Earlier, the UP government as well as Allahabad High Court has dismissed the petitioner demand for launch of prosecution against Yogi in hate speech.
