JAMMU: The Jammu and Kashmir High Court has set aside the earlier dismissal of a complaint alleging criminal trespass, assault and intimidation, paving the way for registration of an FIR against two advocates and a serving Police Sub-Inspector in Jammu after nearly two-and-a-half years of legal proceedings.
Bakshi Nagar Police have registered FIR No. 0149/2026 against Advocate Sumit Nayyar, Sawan Nayyar and PSI Anil Thapa following subsequent directions issued by the Forest Magistrate, Jammu, who found prima facie grounds for cognizable offences and ordered registration of a case under relevant provisions of law.
The allegations pertain to incidents reported in April–May 2024 and also include accusations of misuse of official authority.
The High Court, through its order dated July 3, 2026, set aside the earlier dismissal of the complainants’ plea and directed its further consideration. Acting thereafter, the Forest Magistrate passed directions for registration of the FIR.
The complainants pursued the matter through their counsel, Advocate Aditya Gupta, despite prolonged delays in securing police action.
The development brings renewed focus on the importance of judicial oversight and due legal process in ensuring that allegations of cognizable offences receive appropriate consideration, irrespective of the position or professional standing of the persons named.
