Though post publication of series of news stories on illegal colonies carried by JK Global News, the JDA constrained to publish the notice in a larger circulated English Daily. However, the font size of a significant public notice of larger public interest was so minute that it was not possible to read it without a magnifying lens. The JDA and DIPR as well as the Newspaper management are answerable to public as what were the pressing circumstances for publication of Important Notice in such a narrow manner. The important ingredient of Time Duration to apply before Authority for permission prior to development of colonies post notice is also missing which points finger of suspicion on real intention of JDA to crackdown against developers of new illegal colonies.
JAMMU: In the larger interest of citizens, the Jammu Development Authority (JDA) taking cognisance of serious issue of mushrooming of new unauthorised colonies have published public notice warning strict action against the developers for establishing illegal colonies within its jurisdiction.
As per notice No JDA/CA-60 dated 22-02-2022 published in Daily Excelsior on page 11, in its edition dated February 26, 2022, the Vice Chairman, JDA, Pankaj Magotra while taking serious notice of mushrooming of unauthorised colonies in Chowadhi, Barn, Vijaypur, Bishnah, Harsh Dabar, Jagti, Kotli Charka, Kotli Mian Fateh, R.SP.Pura, Mehmoodur, Deoli, Birpur, Bahu, Baribrahmana, Samba, Niki Tawi Area, Phallian Mandal, Chak Bhalwal, Kangermorh, Gharota (alongside ring road), Ghaink Seri, etc aware the citizens that most of these illegal colonies located in areas which have been reserved as open spaces in the land use these activities are in contravention of Jammu Master Plan 2032 on which no building activity can be undertaken, rendering Layout and sale of plots on such areas is liable for action under J&K Development Act 1970 by way of demolition and sealing besides getting ineligible for grant of Housing loan, water and electricity connections.
The notice further reads ” As per Regulations 4 of the Control of Building Operation Regulations 1998, every person desirous of undertaking development of any site or area or excavation or layout by means of access to the road have to apply to the Chairman of the concerned Authority and get approval under relevant sections of laws”
Stressing that the JDA has already initiated strict action against several upcoming illegal colonies in the mentioned area which as per record have not taken necessary approval from the authority, the notice reads” the list of illegal colonies shall soon be uploaded for citizens which can be accessed on its website www.jda.jk.gov.in”.
While advising the general public not to purchase plots, flats and house in such illegal colonies, the JDA directs the intended developers to seek permission from the Authority and adhere to J&K Building Bye Laws 2021, land use compliance before selling plots gullible buyers.
