Jammu: The Jammu and Kashmir and Ladakh High Court has declined to entertain an application filed by two IAS officers seeking impleadment in the PIL concerning the infamous Arms Licences Scam, while directing the Centre to submit a comprehensive report on compliance with its previous orders.

A Division Bench comprising Chief Justice Dr Pushpendra Singh Bhati and Justice Rajnesh Oswal dismissed as withdrawn the application filed by Pandurang Kondbaroa Pole (AGMUT: 2004), Secretary, Land and Building, Delhi Government, and Shahid Iqbal Choudhary (AGMUT: 2009), Secretary, Government of Arunachal Pradesh.

The officers had sought directions to the Department of Personnel and Training (DoPT) to consider their representations before taking a decision on the CBI’s proposal for grant of prosecution sanction against them.

The Bench observed that there was no justification for issuing such a direction, particularly when the officers could pursue their representations before the competent authority independently.

During the hearing, counsel for the PIL petitioners, Advocate S.S. Ahmed, informed the Court that the Ministry of Home Affairs (MHA) had finalised its views after consultation with the investigating agency and the J&K Government and forwarded its opinion to the DoPT for a final decision on the prosecution sanction proposal.

Seeking further directions, Ahmed urged the Court to call for the DoPT’s final decision. The Bench directed Deputy Solicitor General of India appearing for the Union of India, to submit a comprehensive report on compliance with its previous order and listed matter for further hearing on December 23, 2026.
