    DC to face contempt proceedings for faceoff with Judge

    SRINAGAR : Contempt proceedings for alleged misuse of official power and misconduct has initiated by a local court against Deputy Commissioner, Ganderbal, Shyambir.

    As per the reports, the court of Sub Judge Ganderbal, Fayaz Ahmad Qureshi, passed the detailed order on July 23, mentioning serious accusations against the DC, Ganderbal for not complying to a judgement passed by the court for execution of a decree in favour of petitioners who sought enforcement of a judgement dated October 31, 2022.

    The court in its order dated June 21, 2024 while attaching salaries of the judgment-debtors, including Deputy Commissioner Shyambir for non-compliance of court order observed, “The DC , Ganderbal, Shyambir allegedly engaged in actions which intended to intimidate actions and undermine the presiding officer, who had passed the order against him.

    Following the court’s order, Shyambir, “attempted to personally attack the Presiding Officer by scandalizing him and weakening him by manipulation and fabrication by initiating a series of steps which includes forming a committee to survey the judge’s property under ‘dubious’ pretenses thereby undermining the authority and dignity of the court”.

    The court in its order further said that this action was a clear abuse of official power as the committee constituted for demarcation of presiding officer property is clear abuse of the official position as neither the judge moved any application for demarcation nor any notice was ever given to presiding officer for demarcation of his land which shows DC vendetta against him post the order was passed against the later.

    The Court has scheduled the next hearing for the execution petition on August 14, next month, and has directed that the contempt part of the petition be diarized separately and listed on July 29, 2024.
