Flagging social divide, SC puts UGC caste equity rules in abeyance

The Supreme Court on Tuesday put in abeyance the University Grants Commission’s (UGC) contentious caste-based equity notification, observing that such measures could further divide society rather than promote harmony.
The apex court made the remarks while hearing petitions challenging the notification, which sought to introduce caste-linked representation norms in higher education institutions.

A bench of the Supreme Court noted that while social justice and inclusion are constitutional goals, policies framed without broader consensus and clarity may deepen existing fault lines. “Equity measures should unite society, not fragment it on caste lines,” the court observed, stressing the need for a balanced and inclusive approach.

The court directed the UGC to maintain status quo and sought detailed responses from the Centre and other stakeholders on the rationale and implementation of the notification. Petitioners argued that the move undermines merit and institutional autonomy, while the government defended it as a step towards inclusive education. Further hearing in the matter has been scheduled.
